HOW TO REGISTER A FOREIGN/INTERNATIONAL NON GOVERNMENTAL ORGANISATION/THEIR BRANCH(NGO) IN RWANDA.
The Non Governmental Organizations in Rwanda are regulated by the LAW Nº05/2012
OF17/02/2012 GOVERNING THE ORGANISATION AND FUNCTIONING OF INTERNATIONAL NON
-GOVERNMENTAL ORGANISATIONS. The Act
governs the registration, management and governance of Non Governmental
Organizations
- Consult in order to get guidance; list of Requirements and detailed information regarding registration.
- Consult the District you intend to operate in order to harmonize INGO action plan with the District development Programs (DDP). However, this is not applicable to INGOs operating on the Central level. (NB. Central level INGOs are the INGO operating directly with the line Ministries National level.)
- If the process of registration is carried out by a foreigner he or she is advised to request a special pass for three months from the DGI&E in order to legally stay in Rwanda where necessary.
- Foreign NGO members should convene a meeting wherein they should agree and resolve to register their NGO chapter/branch in Rwanda.
- The resolutions of the meeting should be reduced in writing and members sign against their names.
- The foreign NGO should then appoint their representative and vice representative.
- If the representative is not the founder or CEO/PRESIDENT OR WHATEVER NAME CALLED, the Foreign NGO must grant powers of ATTONEY to their representative
- Obtain recommendation letter from the country of origin where the NGO operates from
- Have the recommendation letter notarized by a notary public from where it was issued from.
- As NGO obtain a letter from your headquarters authorizing to operate another branch in Uganda.
- Have the letter also notarized by a notary public from where it was issued from.
- Make a copy of the constitution/by laws/rules of foreign organization.
- Proceed to certify a copy of the constitution/by- laws/rules of foreign organization at the forum it was registered in the country of origin.
- Take the certified copy of the constitution/by- laws/rules of foreign organization for notorising by a notary public in the country of origin.
- Get a local partner/representative with whom you intend to operate the organization if possible.
- Proceed to execute memorandum of understanding between yourself as a foreign ORGANISATION and the local partner/representative / promoter
- Apply to the line ministry for partnership
- Execute a memorandum of Understanding between the Organization and the relevant line Ministry in Rwanda.
- Obtain certificate of no criminal record/certificate of good conduct from the country of origin in respect with the representatives and the vice representative.
- Photocopy qualification documents including evidence of work experience of foreign workers/volunteers coming to work in Uganda.
- Photocopy documents showing the immigration status of the foreign representatives
- Have Curriculum Vitae of the foreign representatives and expatriates intending to work for the organization in Rwanda.
- Prepare application for temporary certificate of foreign NGO in Rwanda.
- Prepare Annual action plan for fiscal year (July-June) aligned with the vision 2020/EDPRS III and DDP (District Development Plan). (Action Plan template is accessible on the DGIE website),
- Prepare Notarized Statute/Bylaw issued by competent Authority of the country where that INGO’s Head Office is located,
- Prepare Signed proof of funding/or a commitment letter from the donor or INGO international head office,
- Prepare Detailed Annual Budget for July-June Fiscal year (administrative and developmental budget) ,
- Prepare Proof of submission of agreed on action plan from the respective districts of operation. This is prepared using the Application form at the District level (Action Plan template is available from the DGI&E website),
- Prepare Organizational structure of the INGO in Rwanda.
- Accompany/attach your application with all the documents mentioned above.
- Have the application for registration of foreign NGO assessed pay accordingly.
- Submit the application for registration of the foreign NGO together with all the mentioned documents and payment receipts to DGE&1 FOR PROCESSING.
- While submitting your documents inquire when to check on the progress of your application
- the board shall sit and consider your application for registration of INGO.
- If the board is satisfied with your application for registration, it will issue certificate of registration /permit in a prescribed form to operate in Rwanda.
