HOW TO TRANSFER LEASEHOLD LAND, FREEHOLD LAND and MAILO LAND
Every person has a right to own property either individually or in association with others (article 26(1) of the 1995 Uganda constitution).
Land can be owned as per article 237 of the Constitution and section 2 of LAND ACT 1998 namely, customary land; freehold land; mailo land; and leasehold land.
The proprietor of land or of a lease or mortgage or of any estate, right or interest therein respectively may transfer the same by a transfer in one of the forms in the Seventh Schedule to RTA; but where the consideration for a transfer does not consist of money, the words “the sum of” in the forms of transfer in that Schedule shall not be used to describe the consideration, but the true consideration shall be concisely stated (section 92 (1) of RTA).
• The registered proprietor signs A Transfer form describing the land being transferred in favor of the transferee.

• The transferee signs on the transfer form too together with two consent forms.
• Both the transferor/seller/donor and transferee/buyer/donee should attach their respective passport photos On the transfer forms and their identifications cards
• Take the transfer forms to the lawyer or a qualified person for witnessing the transfer.
• Present the documents to the Valuation Division for valuation assessment for Stamp duty.
• The property or land is assessed at market value by or on behalf of chief government valuer at respective district land registries.
• Checks with the Valuation Division to pick the form and proceed to pay stamp duty and registration fees in the Bank. Stamp duty is 1.5% of the value of the land as assessed by the Chief Government Valuer.
• Pay the stamp duty and registration fees in the bank advised and get a receipt and transfer form embossed by Uganda Revenue Authority (URA).
• Submit all documentation together with the Duplicate certificate of Title, Receipts and Photocopies of all documents to the Office of Title.
• The photocopy is stamped ‘Received’ and returned to the client and told when to pick Duplicate Certificate of Title.
• Presents identification documents and the Photocopies to collect the Duplicate Certificate of Title.
• If the transfer is done you sign for the Title and the Photocopy is stamped ‘Returned’ on completion.
