HOW TO DRAFT POWERS OF ATTORNEY IN UGANDA.
It is a requirement under the law to provide powers of attorney to your representative/authorized person to take an action for and on your behalf legally like selling property, transferring property, bidding, suing, registration of rights, signing documents among others.
The power of attorney may be drafted as follows
- Provide the title of the document including the law applicable
- Indicate the type of power of attorney (special/specific or general)
- indicate full names, address and capacity of grantor/Donor
- indicate Full names, address and capacity of the Donee/beneficiary
- indicate subject and scope of the power of attorney(terms/conditions)
- provide determination of the place where the power of attorney will be executed
- indicate commitment by the grantor to be bound by the acts of the agent within the power of attorney
- power of attorney signed by the beneficiary/Donee with identification document
- provided date on which the power of attorney takes effect for a grantor whose habitual residence or principal place of business is located outside the Republic of Rwanda
- the power of attorney must be commissioned by commissioner of author or notarized depending on where the it will be submitted
