HOW AN INDIVIDUAL OR ENTITY MAY INSTITUTE A COMMERCIAL CASE IN COURTS OF RWANDA

  1. Get all the evidence you have on the issue
  2. Seek guidance from a lawyer who will advise you accordingly, at this stage discuss your interest or your expectations with the lawyer
  3. The lawyer will then establish whether your issue is of a commercial nature and if so if you have a cause of action among others
  4. Based on your claim the lawyer will use the law to determine whether the matter need to be filed at commercial court or commercial High court
  5. Where you have a cause of action under the law ,pleadings will be prepared and filed in the appropriate Commercial Court.
  6. You will then have to notify the defendant about the cases by serving him or her with the pleadings
  7. Court shall then fix the matter for pretrial meeting and issue summons that court process server will have to effect on the defendants and file back evidence of service
  8. Pre trial meeting shall be conducted where issues and facts will be agreed upon
  9. If pretrial meeting is concluded, pretrial meeting report shall be prepared and sent to the judge and the hearing shall then be fixed.
  10. The matter shall be heard and determined after which the successful party will proceed to execute in case the other party does nit comply with courts pronouncement
