HOW TO RESOLVE A COMMERCIAL DISPUTE IN RWANDA.
- Seek guidance from transactions lawyer of your choice about your dispute.
- The dispute can either be resolved through mediation, arbitration or court litigation.
- mediation, it is advisable to seek a lawyer’s assistance on how to legally go about the same however you should be willing to stick to your interests not positions.
- Arbitration, you will need services of a lawyer to guide you through, assist or represent you in Arbitration process.
- Court litigation, all commercial disputes which are intended to be filed in court for determination should be lodged either in commercial court or commercial High court depending on the value of the subject matter.
- When the matter is filed at commercial court or commercial High court, the option of mediation is still available to willing parties.
- A commercial matter filed in other courts in Rwanda other than commercial court will most likely be dismissed with costs unless the law allows the same.
